1. Petition #2889 – Toledo Sign/St. Mary Church-8200 N. Wayne Road
To consider the request of Toledo Sign/St. Mary Church, for two variances from Ordinance 248 in order to install an eight (8) foot high, 44 square foot sign that includes a 23 square foot LED display on the church site which is in a residential district, resulting in the following deficiencies:
a) A two (2) foot sign height deficiency. The petitioner proposes to install an eight (8) foot high, 44 square foot sign that includes a 23 square foot LED display on the church site which is in a residential district. (Section 110-15.4.5 allows a six (6) foot high sign)
b) A sign type variance. The petitioner proposes to install an eight (8) foot high, 44 square foot sign that includes a 23 square foot LED display on the church site which is in a residential district. (Section 110-15.4 states that LED displays are only permitted in commercial districts)
2. Petition #2890 – Jacob, Isaac & Marcus, LLC-35500-35600 Central City Parkway
To consider the request of Jacob, Isaac & Marcus, LLC-35500-35600 Central City Parkway for three (3) variances from Ordinance 248 in order to allow for the re-use of an existing, 85,003 square foot building for food and ice manufacturing and in order to divide the parcel upon which it sits into two (2) separate parcels with a common property line running roughly down the middle of the existing building, resulting in the following deficiencies:
a) A use variance deficiency. The petitioner proposes to re-use the property for food and ice manufacturing. (Section 110-9.5.1 does not list food and ice manufacturing as a permitted use in the CB-2, Shopping Center Commercial District)
b) A minimum lot size deficiency. The petitioner proposes to divide the property into two (2) separate parcels, resulting in a lot size less than the required four (4) acres. (Section 110-9.5.4(a) requires a minimum lot size of four (4) acres)
c) A 24 foot side yard setback deficiency. The petitioner proposes to divide the property into two (2) separate parcels with a common property line running roughly down the middle of the existing building resulting in a side yard setback of zero. (Section 110.9.5.5(a) requires a minimum side yard setback of 25 feet)
